The U.S. MSB license is regulated and issued by the U.S. Department of the Treasury, specifically by FinCEN (Financial Crimes Enforcement Network). It is a type of financial license recognized and accepted in all 51 states in the U.S. With few exceptions, every two years, companies engaged in relevant business in the U.S. must update their MSB license with FinCEN. Applying for the U.S. MSB license requires registering a company in the U.S., and the company name must not be identical. FinCEN may impose fines, civil penalties, and criminal penalties for violations.
In March 2013, FinCEN issued the "Guidance on the Application of FinCEN's Regulations to Persons Administering, Exchanging, or Using Virtual Currencies," stating that cryptocurrency "administrators" (such as asset issuers) and "exchangers" (such as exchanges) providing services to U.S. citizens fall under the MSB category of the Bank Secrecy Act (BSA) and need to apply for the MSB license with FinCEN.
Currently, regulations in various countries regarding the cryptocurrency sector may differ, but strengthening regulatory efforts, improving industry access, and protecting investor rights are mainstream trends. Therefore, many countries license and regulate the cryptocurrency market to ensure the industry's standardized and healthy development.
